Today, five Notices of Proposed Rulemaking (NPRMs) governing implementation and administration of the Workforce Innovation and Opportunity Act (WIOA) were posted on the Federal Register website. NSC will post an initial analysis of the regulations in the coming days, and will provide formal comments to the agencies during the comment period.

The regulations include specific regulatory proposals, as well as key questions posed to the field for response. Individuals or organizations that wish to comment on the proposed rules must do so through www.regulations.gov within 60 days, or June 15, 2015.
In a February Training and Employment Guidance Letter (TEGL), ETA indicated that in addition to the regulations, the agencies would release operating instructions and operating and programmatic guidance, and will provide technical assistance. Last week, DOL released operational guidance regarding the WIOA youth program. We expect more guidance and assistance to follow in the upcoming weeks and months.
Since WIOA passed last year, National Skills Coalition and our partners have weighed in on several occasions with agency officials regarding the regulations. NSC staff, along with Workforce Data Quality Campaign (WDQC) staff attended a November town hall meeting convened by DOL and ED that solicited input from national, state and local workforce development professionals about how to regulate portions of the law related to data and accountability. Additionally, Business Leaders United (BLU) hosted the DOL Employment and Training Administration (ETA), the ED Office of Career, Technical, and Adult Education (OCTAE), and the White House during BLU’s January fly-in and in February, NSC partners communicated with ETA, OCTAE, and DOL Secretary Tom Perez during NSC’s annual Skills Summit. NSC partners also engaged with the agencies by participating in numerous town halls and webinars over the past several months.
